1. Introduction

These Terms & Conditions (“Terms”) govern your participation in the Pebble Creek Produce order‑reminder text‑messaging service (the “Service”). By providing your mobile phone number and opting in to receive SMS messages, you agree to be bound by these Terms.

2. Eligibility & Opt‑In

  1. Eligibility: You must be at least 13 years old (or the age of majority in your jurisdiction, whichever is higher) and possess a valid mobile phone capable of receiving SMS messages.
  2. Opt‑In Process: You may opt in by:
    • Sending the keyword START to (616) 730-8995, or
    • Confirm with your sales rep you want to be added to the Service list
  3. Upon successful opt‑in, you will receive a confirmation message (“You are now opted in to receive order updates and reminders from Pebble/Stoney Creek. Reply HELP for help. Reply STOP to unsubscribe. Msg&Data Rates May Apply.”).

3. Message Content & Frequency

  • Purpose: Messages are strictly limited to order‑related notifications such as order confirmations and reminders.
  • Frequency: You will receive no more than 3 messages per order event. Typical volume is 1–3 messages per transaction.

4. Opt‑Out / Unsubscribe

  • To stop receiving messages, reply STOP to any received SMS. You will receive a confirmation (“You have successfully been unsubscribed. You will not receive any more messages from this number. Reply START to resubscribe.”).
  • After opting out, you may re‑subscribe at any time by following the opt‑in process described in Section 2.

5. Fees & Carrier Charges

  • Standard carrier rates for receiving SMS apply. Pebble Creek Produce does not charge additional fees for the Service.
  • If you send a message to (616) 730-8995, standard messaging rates may apply, and you are responsible for any charges incurred.

6. Privacy & Data Protection

  • Data Collected: Your mobile number, order details, and related transaction data are stored solely to deliver the Service.
  • Use of Data: We will not sell, rent, or share your phone number with third parties except as required to operate the Service (e.g., Twilio).
  • Retention: Phone numbers are retained only as long as you remain an active customer or until you opt out.
  • Security: All communications are transmitted via Twilio’s secure, encrypted platform in compliance with industry standards.

7. Compliance with Twilio & Regulatory Requirements

  • The Service complies with Twilio’s Messaging Guidelines, including:
    • Obtaining explicit consent before sending messages.
    • Providing clear opt‑out instructions in every message.
    • Limiting message content to transactional purposes.
  • We also adhere to applicable telecommunications regulations.

8. Disclaimer & Liability

  • No Warranty: The Service is provided “as‑is.” We do not guarantee uninterrupted delivery of messages.
  • Limitation of Liability: To the maximum extent permitted by law, Pebble Creek Produce shall not be liable for any indirect, incidental, special, or consequential damages arising from the use or inability to use the Service, including but not limited to loss of profits, data, or goodwill.

9. Modifications to These Terms

We reserve the right to modify these Terms at any time. Changes will be posted on our website and, if material, we will notify you via email or SMS. Continued use of the Service after modifications constitutes acceptance of the revised Terms.

10. Governing Law & Dispute Resolution

These Terms are governed by the laws of Michigan, without regard to conflict‑of‑law principles. Any disputes will be resolved in the courts of Grand Rapids, Michigan.
